1.1. This Acceptable Use Policy (“AUP”) sets out the rules and principles governing the use of the services, systems and equipment made available by HOSTEAZA SRL in connection with the services provided to our clients.
1.2. “User(s)” or “you” refers to clients or any person who accesses or uses our services.
1.3. HOSTEAZA SRL may amend this policy. Significant changes will be communicated to you by email or through the client portal, in accordance with the Terms and Conditions, before they enter into force. We recommend periodically checking our website for any updates.
2.1. We have the right to investigate any suspected violation of this policy. The investigation may include collecting information from the user involved and the complaining party, as well as reviewing materials hosted on our servers or equipment.
2.2. In the event of abuse or violations, we may take measures at our discretion, including: (a) an informal request for cooperation; (b) a written warning; (c) suspension of the service (with or without notice); (d) restriction of access to the contracted services (with or without notice); (e) termination of the services (with or without notice).
2.3. We may issue a formal warning specifying the nature of the violation and informing you that repetition may result in suspension or permanent termination of the services.
2.4. If, following a warning, the abusive behavior continues, the services will be suspended until the situation is remedied and you undertake clear compliance measures.
2.5. The suspension may be lifted only after receipt of a written undertaking that no future abuse will occur. Until this undertaking is received, the services will remain suspended. HOSTEAZA SRL is not responsible for delays or losses caused by the transmission of communications (mail, email).
2.6. Before termination, we may decide, at our discretion, to work with the user in order to prevent repetition of the violation.
2.7. In the case of resellers, responsibility for informing end users about measures taken under this policy lies exclusively with the reseller.
2.8. The measures provided for in this section apply under the conditions of Sections 9 and 34 of the Terms and Conditions of HOSTEAZA SRL and of the DSA and DMCA Policy. For any restriction applied to your services or content, you will receive the reasons for the measure and may appeal it at [email protected] or through a ticket in the client portal, and the appeal will be reviewed by a person other than the person who made the decision.
3.1. Our services may not be used for illegal purposes or in ways that cause harm to other users. You are also responsible for preventing third parties from using your connection abusively.
3.2. You are required to comply with all applicable laws and regulations and to ensure that other persons who use the services through your account comply with the same rules. You are responsible for any use of the services, even when such use occurs without your knowledge.
3.3. You are required to keep the contact details provided to HOSTEAZA SRL up to date, as these are used to send you official notices.
3.4. If your services are subject to an investigation by the authorities, we reserve the right to suspend them for the duration of the investigation.
4.1. The automated backups performed by HOSTEAZA SRL for cPanel hosting packages are optimized to protect critical data (source code, databases, configurations). In order to maintain the performance of the backup infrastructure and prevent excessive use of resources, certain types of files are excluded.
4.2. Extensions EXCLUDED from backup:
4.3. Rationale: large media files, archives and system images significantly increase the volume and duration of the backup/restore window, may affect RPO/RTO and may degrade the experience of all clients using the same infrastructure.
4.4. Clients who require these files to be archived are responsible for creating their own backups on external storage or dedicated services. Upon request, we may offer alternatives (e.g. dedicated storage, object storage, on-demand snapshots) for an additional fee.
4.5. HOSTEAZA SRL reserves the right to update the list of excluded extensions depending on operational requirements and internal security and performance policies.
5.1. Service security – The safe use of the services is entirely your responsibility. HOSTEAZA SRL is not responsible for consequences caused by the absence of adequate security measures (e.g. data loss, identity theft, fraud).
5.2. Device security – Users are responsible for protecting the systems and devices connected to our network. If they generate abuse (e.g. botnet, malware), the services may be suspended without notice. You must take reasonable measures to protect your own systems. We are not liable for damages resulting from such incidents.
5.3. Account security – Passwords must be kept confidential. If you suspect that they have been compromised or that your account/devices have been used without authorization, immediately change your access credentials and inform us as a matter of urgency.
6.1. You are prohibited from taking measures that prevent or restrict the legitimate use of the services by other clients or third parties.
6.2. Examples of prohibited actions:
7.1. The storage, transmission or publication of “prohibited” materials through our services, including by email, forums or social media, is prohibited. Prohibited materials include, without limitation:
7.2. Phishing (fraudulently obtaining personal data through deceptive methods) is prohibited.
7.3. The distribution or hosting of pirated software or unlicensed materials constitutes a serious violation of this policy.
7.4. HOSTEAZA SRL reserves the right to remove or block any non-compliant material and to inform the competent authorities where there is suspicion of illegality. Any person may report illegal materials to us at [email protected] or through the “Report Abuse” form, in accordance with the DSA and DMCA Policy.
8.1. The development, hosting or operation through our services of artificial intelligence systems that carry out practices prohibited by Article 5 of Regulation (EU) 2024/1689 is prohibited, including:
8.2. If you make an artificial intelligence system available to the public, you are responsible for complying with the applicable transparency obligations, in particular informing persons that they are interacting with an AI system, marking artificially generated content and labeling deepfake content.
9.1. Adult content is permitted only if it is legal, if all persons depicted are adults and have given their consent, and if you implement effective measures to restrict access by minors, in accordance with the laws of each country in which the content is accessible, including, for the United Kingdom, the age verification requirements of the Online Safety Act 2023.
